The Director of Legal Services is responsible for facilitating quality and timely delivery of legal services to CHC/SEK leadership, staff, and business associates. This position is responsible for providing supervision, direction, and support for the legal department to ensure timely response and execution of legal matters. The Director assists the Chief Compliance Officer (CCO)/General Counsel in protecting CHC/SEK’s legal interest and maintaining operations within the scope of CHC/SEK policies, procedures and state and federal laws. The Director of Legal Services researches and provides hands-on legal counsel to executive and leadership staff to identify and analyze legal issues, draft business documents, provide recommendations, assist in business negotiations, review and/or revise policies and procedures, and all other legal matters that may arise. The Director is expected to serve as a subject matter expert, educational resource, and problem solver for CHC/SEK staff on all aspects of regulatory issues and healthcare transactions.
Requirements:1. Juris Doctorated (JD) from an ABA-accredited law school.
2. Licensed and in good standing to practice law in the State of Kansas.
3. Must be licensed and in good standing to practice law in the State of Oklahoma within two (2) years of hire.
4. Experience in a healthcare, legal counsel role, preferred.
5. Four (4) years of experience as a practicing attorney.
6. Two to Four (2-4) years of managerial experience, preferred.
Essential Duties
- Supervises, provides direction, and mentors the legal department to ensure timely, accurate response regarding legal matters.
- Creates functional strategies and objectives to support CHC/SEK in compliance, business transactions, and regulations.
- Cultivates, develops, collaborates, and maintains relationships with legal and compliance department employees, as well as CHC/SEK directors to maintain compliance with credentialing and contracting, health information, risk management, and quality-based matters.
- Provides legal counsel regarding regulatory issues including, but not limited to, HIPAA, FERPA, FTCA, reimbursement, fraud and abuse, Safe Harbor, Stark, and Anti-kickback issues.
- Drafts, reviews, and recommends appropriate contracts, forms, and structure for CHC/SEK transactions including, but not limited to, clinical services agreements, vendor agreements, business acquisitions, lease agreements, to ensure these items are in line with federal and state laws, as well as regulatory requirements.
- Provides key legal support for transactional and strategic initiatives, including conducting due diligence, drafting transactional documents, and collaborating with outside counsel, as necessary.
- Assists with preparation, review, and revision of corporate governance documents and system policies and procedures.
- Prepares and provides educational presentations on topics relating to regulatory compliance.
- Conducts legal research and helps monitor health care transaction and regulatory legislation, and participates in work groups or with special projects to operationalize changes in legislation that affect CHC/SEK.
- Maintains a legal consultant role with CHC/SEK subsidiaries and outside organizations, as needed and assigned, for the completion of projects.
